2. Description of Service

GrowthUp provides an AI-powered platform that analyzes social media performance data and generates personalized growth recommendations. We connect to your social media accounts (currently starting with Instagram) to provide insights and actionable plans for growing your online presence.

3. Account Requirements

To use GrowthUp, you must create an account and be at least 16 years of age. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Social Media Connections

When you connect social media accounts to GrowthUp, you authorize us to access and analyze your account data in accordance with each platform's terms of service and API policies. You can disconnect accounts at any time. We only access data necessary to provide our services and do not post content to your accounts without your explicit permission.

5. Acceptable Use

You agree to use GrowthUp only for lawful purposes and in accordance with these Terms. You agree not to: use the service in any way that violates applicable laws or regulations, attempt to gain unauthorized access to our systems, interfere with or disrupt the service, or use the service to generate content that violates the terms of connected platforms.

6. User Content

You retain ownership of all data and content you provide to GrowthUp. By using our services, you grant us a limited license to use, process, and analyze your data solely for the purpose of providing our services to you. We do not claim ownership of your data.

7. Subscription and Payments

GrowthUp may offer paid subscriptions. Subscription fees will be clearly communicated before you purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. We reserve the right to modify subscription fees with appropriate notice.

8. Disclaimers

GrowthUp provides recommendations based on data analysis, but we cannot guarantee specific results. Social media growth depends on many factors outside our control. The recommendations provided are suggestions, and you remain responsible for your own content and actions on social media platforms.

9. Limitation of Liability

To the maximum extent permitted by law, GrowthUp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

10. Termination

You may terminate your account at any time by contacting us or through your account settings. We may suspend or terminate your access to the services if you violate these Terms of Service or engage in behavior that we believe is harmful to our platform or other users.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms of Service on this page and updating the "Last updated" date. Your continued use of the service after any changes constitutes acceptance of the new terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
